Is Content Moderation Censorship?

When social media platforms remove posts, ban users, or suppress content, are they engaging in censorship — or exercising legitimate editorial discretion?

Content moderation — the practice of reviewing and enforcing rules about what content is permitted on a platform — has become one of the most contested free speech questions of the internet age. The Case for More Speech

Platforms bear real costs from harmful content. Harassment, child exploitation, and incitement to violence are not just legal risks — they are genuine harms that platforms have legitimate interests in preventing.

No platform is obligated to provide a megaphone. The right to speak does not create an obligation for any particular platform to amplify that speech.

Alternatives exist. Users who find major platforms too restrictive can and do use alternative platforms.

The question of when powerful private actors can restrict speech has a long history. In the print era, newspapers exercised editorial discretion over what they published. In the broadcast era, the FCC regulated content on licensed spectrum. The internet has created a new form of communication infrastructure — private, global, unregulated — that does not fit neatly into either model.

First Amendment Context

In Moody v. NetChoice (2024), the Supreme Court considered state laws restricting platform moderation and sent the cases back to lower courts while signaling that platforms have substantial editorial freedom.
