An AI recommendation system learns from billions of behavioral signals to optimize for engagement metrics that may themselves have been chosen without direct human decision about any particular content outcome. The question of who is "deciding" what content is amplified — and therefore who bears responsibility for those decisions — is genuinely novel.

The adversarial dynamics of AI-platform regulation create a technical arms race. As platforms are required to disclose more about their ranking systems, sophisticated actors — disinformation operations, spam networks, SEO manipulators — will use that information to game the system more effectively. Regulatory transparency requirements must be designed with these adversarial dynamics in mind: more transparency for auditors and researchers, not necessarily more transparency about specific ranking signals that can be exploited. The EU's DSA attempts to thread this needle through access-for-researchers frameworks rather than full public disclosure of algorithmic parameters.
