Does Social Media Censor Speech?
When platforms ban users, remove posts, or suppress content, is that censorship? The answer depends on whether you view dominant platforms as private companies or de facto public squares.
The Core Question
When Twitter suspended Donald Trump, when Facebook removed COVID-19 content, when YouTube demonetized channels discussing certain political topics — was that censorship?
The legal answer is clear: no. Private companies are not bound by the First Amendment. They can moderate content, enforce terms of service, and make editorial decisions without violating anyone's constitutional rights.
The democratic and cultural answer is more complicated. When a handful of platforms effectively control the channels through which most political speech reaches most Americans, treating those decisions as purely private and entirely unproblematic seems incomplete.
Section 230 and Platform Liability
Section 230 of the Communications Decency Act (1996) is the legal backbone of internet platform moderation. It provides two key protections:

Critics on both left and right have called for Section 230 reform, though for different reasons: the right argues it enables censorship of conservative voices; the left argues it enables platforms to profit from harmful content without accountability.
The Public Square Argument
The most significant challenge to the purely private status of social media platforms is the public square analogy. In Packingham v. North Carolina (2017), the Supreme Court called social media platforms "the modern public square" and struck down a law restricting sex offenders from accessing them.
If social media is the modern public square, should dominant platforms be held to standards similar to those that apply to government-owned public forums? This is the central question in platform speech law.
The argument for treating platforms like public squares rests on: their dominance (no meaningful alternative exists for much public discourse), network effects (leaving Twitter or Facebook means leaving the conversation), and the fact that exclusion from these platforms is functionally equivalent to exclusion from public life for some speakers.
High-Profile Deplatforming Cases
Several high-profile deplatforming decisions have fueled the censorship debate:
**Donald Trump (2021)**: Twitter, Facebook, and YouTube suspended or removed Trump following the January 6 Capitol attack. Supporters called it political censorship; critics argued it was an appropriate response to content that incited violence.
**Alex Jones / InfoWars**: Multiple platforms removed Jones in a coordinated action in 2018, citing harassment policies. Critics questioned whether this represented coordination between private companies to silence a political voice.
**COVID-19 content**: Platforms removed content that contradicted official public health guidance during the pandemic, including some content that later appeared in mainstream debate (e.g., lab leak hypothesis). This raised questions about platforms' relationship with government health agencies.
**The New York Post / Hunter Biden story**: Twitter and Facebook suppressed sharing of a New York Post story about Hunter Biden's laptop in the weeks before the 2020 election, calling it potentially hacked material. This decision drew criticism for apparent inconsistency with how similar stories were treated.
Government Pressure on Platforms
The line between private platform moderation and government censorship became blurred when internal communications revealed extensive contact between government agencies and tech platforms.
The Twitter Files (2022-2023) and subsequent congressional testimony showed that government agencies including the FBI, CDC, and others had regular communication with platform trust and safety teams about specific accounts and content. Courts split on whether this government pressure constituted unconstitutional coercion.
The Supreme Court's Murthy v. Missouri (2024) addressed this directly, holding that plaintiffs had not shown the required direct causation between government pressure and specific platform decisions — but leaving open the broader question of when government-platform collaboration crosses constitutional lines.

The most honest answer to "does social media censor speech?" is: yes, in the ordinary sense of the word, but not in the First Amendment sense.
Platform moderation involves editorial judgment — deciding what to host, what to amplify, and what to remove. Every media company makes such judgments. The difference with dominant platforms is one of scale and lack of alternatives.
The concern is not that platforms should be legally prohibited from moderating content. The concern is that: 1.
