In America, hate speech has no separate legal category — offensive, bigoted speech is generally protected by the First Amendment. Most other democracies have reached a different conclusion.

What Is Hate Speech? Defining the Contested Term

Hate speech generally refers to expression that attacks, degrades, or dehumanizes people based on characteristics such as race, religion, ethnicity, national origin, sex, sexual orientation, or disability. The term is widely used in public debate, in platform moderation policies, and in legislation around the world — but in the United States, it has no separate legal definition or status under First Amendment law.

This is a crucial distinction. When people say 'hate speech isn't protected,' they are often describing a moral or policy position, not a legal fact. In American constitutional law, the question is not whether speech is hateful but whether it falls into one of the recognized categories of unprotected speech: incitement to imminent lawless action, true threats, defamation, obscenity, or fraud. Speech that expresses bigotry, targets people on the basis of race or religion, or seeks to degrade entire groups is generally protected if it does not also meet one of these narrower definitions.

The contested nature of the term itself is part of the legal problem. 'Hate speech' is in the eye of the beholder to a significant degree. Throughout history, speech that dominant groups considered hateful — abolitionist literature, civil rights advocacy, feminist arguments, LGBTQ expression — has been suppressed by authorities claiming to protect social order. This history shapes American skepticism toward hate speech regulation.

Historical Origins: How American Exceptionalism Developed

The American approach to hate speech did not emerge from abstract principle alone — it emerged from specific historical experiences with speech suppression. The suppression of abolitionist literature in the antebellum South, the prosecution of labor organizers and socialists in the early 20th century, the targeting of civil rights activists and anti-war protesters in the 1950s and 1960s — all of these examples involved authorities using legal tools nominally designed to protect order and protect vulnerable people, deployed in practice against the people who most needed speech protections.

The American Civil Liberties Union's defense of neo-Nazi marchers in Skokie, Illinois in 1977 crystallized this tension. The proposed march through a suburb home to many Holocaust survivors was deeply offensive and caused genuine pain. But the ACLU argued, and the courts agreed, that if the government could ban the march because of its message, the same power could be used against any unpopular minority. The ACLU received more cancellations from supporters over this case than any other in its history — but the principle it defended helped preserve speech protections that have been used by civil rights, anti-war, and LGBTQ advocates in subsequent decades.

The comparison to other democracies is illuminating. Most Western nations had different wartime experiences — particularly the Nazi era in Germany and occupied Europe — that made them far more willing to restrict speech that attacks people on the basis of race, religion, or national origin. The German Basic Law, drafted under Allied supervision after World War II, includes specific protections against speech that degrades human dignity and criminalizes Holocaust denial. These different historical trajectories explain much of the divergence between American and European approaches.

The American Approach

Unlike most democracies, the United States has no separate hate speech exception to free speech protection. The First Amendment protects offensive, bigoted, and hateful expression unless it falls into another category of unprotected speech — incitement, true threats, or defamation. The Supreme Court has repeatedly reaffirmed this position: in Matal v. Tam (2017), all eight justices agreed that the government may not restrict speech on the ground that it expresses ideas that many people find offensive. In Snyder v. Phelps (2011), the Court ruled 8-1 that the Westboro Baptist Church's anti-gay funeral protests were protected expression, even when conducted at military funerals and causing extreme distress to the deceased's family.

How Other Countries Handle Hate Speech

Canada, Germany, the UK, and most EU nations have hate speech laws that criminalize speech targeting people based on race, religion, national origin, sexual orientation, or other characteristics. These laws reflect a judgment that protecting human dignity sometimes outweighs absolute free speech. Canada's Criminal Code prohibits public incitement of hatred and willful promotion of hatred against identifiable groups. Germany criminalizes incitement to hatred against segments of the population and the use of symbols of unconstitutional organizations. The European Court of Human Rights has consistently upheld hate speech restrictions as compatible with the European Convention on Human Rights, using a balancing framework that American First Amendment doctrine explicitly rejects.

Arguments Against Hate Speech Laws

Critics argue that hate speech laws give governments dangerous power to define protected identity categories and police offensive expression. The history of hate speech laws shows they are often used against the very groups they are meant to protect — anti-war protesters who offend nationalist sensibilities, religious minorities whose expression is deemed offensive by majorities, LGBTQ advocates in countries where their speech is considered an attack on traditional values. The definition of 'hate' is not objective: it reflects the values and power of those doing the defining. Where the government controls the definition of prohibited hate speech, that power will not be exercised neutrally.

Arguments for Hate Speech Restrictions

Supporters argue that targeted hate speech causes real harm, silences minority speakers, and that a commitment to equal citizenship requires preventing expression that degrades people based on who they are. Critical race theory scholars like Mari Matsuda and Richard Delgado argue that racist speech is not merely offensive but functions as a tool of subordination, perpetuating inequality by making its targets feel unsafe in public spaces. They contend that the 'marketplace of ideas' argument ignores the reality that some speakers start with far more market power than others, and that protecting all speech regardless of its content can entrench rather than challenge existing hierarchies of power.

R.A.V. v. City of St. Paul (1992) struck down a hate crimes ordinance that prohibited placing burning crosses or Nazi swastikas on property, holding that government cannot target speech based on the viewpoint expressed even within a category of unprotected speech. Virginia v. Black (2003) allowed states to criminalize cross burning conducted with the intent to intimidate, while striking down a provision that made cross burning presumptive evidence of such intent. Matal v. Tam (2017) unanimously struck down the prohibition on 'disparaging' trademarks, reaffirming the principle that the government cannot restrict speech simply because many people find it offensive — a decision that had immediate implications for hate speech regulation more broadly.

Internet, AI, and the Global Hate Speech Debate

The internet has made the divergence between American and European hate speech law practically significant in new ways. Global platforms like Facebook, YouTube, and Twitter/X operate across jurisdictions with fundamentally different legal standards. What is legally required moderation in Germany or France may be unconstitutional government action if mandated in the United States. Platforms have increasingly adopted global hate speech policies that in many respects track European standards — removing content that attacks people on the basis of race, religion, and sexual orientation — creating a de facto global standard set by private companies rather than law.

This private-law convergence raises its own concerns. Platform hate speech policies are applied inconsistently, often over-removing marginalized voices who discuss their own experiences with discrimination, and under-removing hate speech from well-connected or large-following accounts that generate engagement and revenue. The enforcement of hate speech policies through automated systems creates systematic errors at scale: AI moderation systems trained to detect slurs may remove discussion of those slurs by the very communities targeted by them.

Generative AI has added new dimensions to the hate speech debate. AI systems can generate targeted, personalized hate speech at scale — flooding individuals with harassment, generating fake images, and creating synthetic content designed to degrade specific people or communities. The same platforms that have adopted hate speech policies for human-generated content are now grappling with AI-generated content that those policies were not designed to address. Meanwhile, the question of what it means for an AI to generate 'hate speech' when the AI itself has no intent, no animus, and no beliefs remains philosophically and legally unresolved.
